1. About these terms
These Terms of Service ("Terms") are an agreement between you and TR Technologies Group Pty Ltd (ABN 45 693 996 379) ("HelloToday", "we", "our", "us") covering your use of the HelloToday mobile application, website, and related services (together, the "Service").
You accept these Terms by creating an account, or by acknowledging them within the app. When you acknowledge the Terms in the app, we record the date and time of your acceptance, and that record forms part of the agreement between you and us. If you do not agree with these Terms, please do not use the Service.
Our Privacy Policy explains how we handle your personal information, including health information such as medication details, and forms part of these Terms.
2. What HelloToday is — and what it is not
HelloToday is an assistance, reminder, and family-communication tool. It lets a person set up daily check-ins and medication reminders, respond to them with a tap, and share that status with nominated family members or trusted contacts.
HelloToday is not a medical device. The Service:
- provides simple scheduling, reminder, and communication functions only;
- does not diagnose, screen for, prevent, monitor, predict, treat, or alleviate any disease, condition, or injury;
- does not provide medical, health, or clinical advice, and does not recommend or adjust any treatment or medication;
- does not analyse or interpret medical or physiological data, and does not monitor any physiological process;
- does not replace clinical judgement, and no health professional oversees or reviews any information in the app.
Any medication information in the app is entered by you (or a person you authorise) and is displayed back to you as entered. Always follow the directions of your doctor or pharmacist. Nothing in the Service is a substitute for professional medical advice, and you should never delay seeking medical advice, or change a medication or dose, because of anything in the app.
3. Not an emergency service
In an emergency, call Triple Zero (000) immediately. Do not use HelloToday to request or wait for emergency help.
HelloToday is not an emergency, medical-alert, or monitoring service and is not connected to emergency services, hospitals, or care providers. Help requests, missed check-in alerts, and missed-dose alerts are informational messages to your nominated contacts only. We do not monitor them, respond to them, or escalate them to anyone. There is no guarantee that a nominated contact will see or act on an alert.
4. No guarantee of delivery
Reminders, check-in notifications, and alerts are delivered through third-party systems that we do not control — including Apple and Google push-notification services, SMS carriers and gateways (such as Twilio), your mobile network, your internet connection, and the settings and condition of your device.
Because of this, notifications and alerts may be delayed, may arrive out of order, or may not arrive at all. Delivery can be affected by device settings (such as Do Not Disturb, focus modes, battery-saver modes, or disabled notifications), a device being off, out of battery, or out of coverage, network outages, and third-party service failures.
You must not rely on HelloToday as your only safeguard for taking medication, checking on a loved one, or any matter affecting health or safety. Always maintain independent routines and direct contact — the Service is a helpful supplement, not a replacement for them.
5. Family visibility is informational
The status that family members and trusted contacts see in HelloToday reflects what the user has marked in the app (for example, tapping a check-in or marking a dose as taken). It is not real-time monitoring or surveillance, and it does not verify that a medication was actually taken or that a person is safe and well.
Status information may lag behind real events due to delivery delays, device or network issues, or a user marking something late or in error. If you are ever unsure about a loved one's wellbeing, contact them directly — by phone, in person, or through someone nearby — rather than relying on the app.
6. Your responsibilities
To get reliable value from the Service, you agree to:
- follow the directions of your prescribing doctor and pharmacist at all times — the app's reminders never override them;
- enter medication names, doses, and schedules accurately, and keep them up to date when your prescriptions change;
- mark check-ins and doses honestly, because your family relies on that status;
- keep notifications for HelloToday enabled on your device, and keep your device charged, switched on, and connected to a network;
- keep your contact details and your nominated contacts' details current;
- only connect family members or contacts who have agreed to be connected, and use the Service only for its intended purpose;
- keep your account credentials secure and not share your account with others.
7. Subscriptions and app stores
Some features of the Service require a paid subscription, billed through the Apple App Store or Google Play. Pricing, billing, renewal, and cancellation are described at the point of purchase and are also subject to the applicable app store's terms. Nothing in this section limits your rights under the Australian Consumer Law, including any applicable refund rights.
8. Warranties and liability
Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Disclaimer. Subject to the ACL and any other rights that cannot lawfully be excluded, the Service is provided "as is" and "as available", and we make no other warranties or representations about the Service — including that it will be uninterrupted, error-free, secure, or that any notification or alert will be delivered or delivered on time.
Limitation of liability. To the extent permitted by law, and other than liability that cannot be excluded or limited under the ACL:
- our liability for a breach of a non-excludable consumer guarantee (where permitted under section 64A of the ACL) is limited, at our option, to resupplying the service or paying the cost of having the service resupplied;
- we are not liable for any indirect or consequential loss, or for loss arising from delayed, missed, or undelivered notifications or alerts, from reliance on the Service as a sole safeguard contrary to these Terms, from inaccurate information entered into the app, or from the acts or omissions of third-party providers (including Apple, Google, and SMS carriers);
- our total aggregate liability in connection with the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the ACL or any other law that cannot be excluded, restricted, or modified by agreement.
Indemnity. To the extent permitted by law, you indemnify us against loss we suffer arising from your breach of these Terms or your unlawful use of the Service, except to the extent we caused or contributed to that loss.
9. Changes to the Service and these Terms
We may improve or change features of the Service over time. We may also update these Terms. If we make a material change, we will give you reasonable notice — for example, by email or an in-app notice — before the change takes effect. Your continued use of the Service after the effective date, or your renewed in-app acknowledgment, constitutes acceptance of the updated Terms. If you do not agree to a change, you may stop using the Service and cancel any subscription.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or close accounts that breach these Terms or that are used unlawfully, and we may discontinue the Service with reasonable notice. Sections of these Terms that by their nature should survive termination (including sections 8 and 11) survive it.
11. General
These Terms are governed by the laws of Western Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia. If part of these Terms is found to be unenforceable, the rest continues to apply. These Terms, together with the Privacy Policy and your recorded in-app acknowledgment, form the entire agreement between you and us regarding the Service.
